Use copies only for preliminary comparison. Before payment, verify the current documents and payment details with the authority or organisation that issued the bill.

How to identify the property and share

The complex name, apartment number, and address from an advertisement are not sufficient. Each calculation must match the official cadastral details: district or settlement, sheet and plan, plot number, registration number, and the name of the right holder.

For the share, record the numerator and denominator or another size specified in the registry. Separately record which part the seller is transferring to the buyer. If the contract describes a specific apartment while the title reflects only a share in the common plot, the lawyer must compare the contractual description with the registered right.

Check the parking space, storage room, garden, terrace, and common areas. They may form part of the transferred right, be a separate property, represent a right of use, or be merely a promise in the contract. This affects not only the scope of rights but also the allocation of certain expenses.

How to determine the payer

Create two columns. In the first, specify the person who is considered the payer under the official assessment or form. In the second, specify the party that must actually bear the expense under the contract. These persons may not be the same.

For example, tax withholding on a transfer is calculated for the seller or another transferring party. If the buyer compensates this amount under the contract, the payment must still be оформed with the correct details of the seller and the transaction. Similarly, an agreement to compensate an old debt does not replace an official receipt confirming its repayment.

Do not limit yourself to the phrases "the buyer pays" or "the seller pays". For each payment, specify the name, period, amount limit, payment date, recipient, and the document that the party must provide after settlement.

How to check the payment history

  1. Prepare a list of tax periods from the date on which the seller acquired the right.
  2. Match each assessment with a receipt.
  3. Check whether the registration number, category, or area of the property has changed.
  4. Request information on the debt and penalties as of the current date.
  5. Check municipal and service-charge bills separately.
  6. Find out whether any payments were made for the entire plot by one of the co-owners.

If another co-owner made the payment, find out what amount they paid, on what basis, and how it was allocated. A bank transfer without an official receipt may confirm that money was sent, but not that a specific assessment was settled.

Which signs require additional verification

  • the bill contains no cadastral details or tax period;
  • the share in the calculation differs from the Land Registry documents;
  • the seller suggests splitting a general bill equally without a written basis;
  • VAT is stated as a single amount without an invoice and explanation;
  • the payment is to be transferred to a private individual even though the recipient should be an authority or organisation;
  • only a bank payment order is shown instead of a receipt;
  • an old debt is included in the price, but the contract does not describe the set-off;
  • you are promised a separate title after payment, but the status of the procedure is not shown;
  • the amount is calculated using the rate from an old transaction or previous year's document;
  • one receipt is used as confirmation for several right holders without a breakdown.

Any of these signs requires clarification, but none of them by itself proves a violation. The purpose of the verification is to link the amount to the document, property, share, payer, and period.

How to pay and obtain the correct receipt

Before transferring money, confirm the recipient's payment details through an official channel. In the payment description, specify the type of obligation, cadastral or registration details, period, and payer's name, if the payment format allows this.

If the money is transferred by a lawyer or representative, agree in advance on the supporting documents. The report should include the amount, date, recipient, basis, a copy of the receipt, and the remaining funds. The power of attorney must cover the relevant action, but it does not itself confirm payment.

Do not accept a receipt without a number, date, amount, and recipient. For a payment relating to a share, check whether the document reflects your specific transaction or a calculation for the entire plot. If the receipt is general, request official confirmation of the allocation.

  1. Compare the amount and purpose in the payment document and the receipt.
  2. Make sure that the correct payer and property are specified.
  3. Obtain confirmation that no balance remains or request a new calculation.
  4. Check whether the related registration action has been completed.
  5. Keep the contract, calculation, bill, receipt, and correspondence together as one file.
  6. Provide copies to the other party within the period established by the contract.

Do not automatically pay the amount found. First identify the creditor, official debtor, property or share, type of payment, period, principal amount, and penalty. Request a document showing that the debt exists as of the current date.

Then compare the debt with the contract. Possible solutions include payment by the seller before the transaction, an agreed deduction from the price, or settlement through a lawyer. The chosen method must specify the amount or a clear formula, deadline, recipient, and list of documents confirming that the debt has been settled.
