Cypriot Patient Awarded €170,000 Compensation for Neurosurgeon’s Negligence
The Supreme Court of the Republic of Cyprus has upheld a district court ruling, granting €170,000 in compensation to a woman who sued a neurosurgeon for medical negligence.
In 2007, the woman underwent neurosurgery. Shortly after the procedure, she began experiencing severe health issues, which led her to file a lawsuit in the Nicosia District Court.
Testimonies indicated that the surgeon failed to provide proper post-operative care and did not address the bleeding that occurred during surgery. This led to a fractured hip and serious complications for the patient. Experts believe the damage could have been avoided if the surgeon had stopped the bleeding in time.
The surgeon's appeal was dismissed. The Supreme Court ruled that the plaintiff did not receive the necessary care, and that the surgeon had failed to inform her about potential risks before the surgery.
In the appeal, the defense presented 12 points, all of which were rejected. The Supreme Court judge emphasized that doctors are required to fully inform patients about the risks they might face, which an average patient would reasonably expect to know before agreeing to surgery.
