A woman who fatally hit a motorcyclist in Nicosia was fined €3,000
The Supreme Court of Cyprus revised the sentence originally imposed by the lower court on a 66-year-old woman found guilty of causing a fatal traffic accident in Nicosia on April 12, 2021.
The defendant pleaded guilty to reckless, careless, or dangerous conduct, in violation of Article 210 of the Criminal Code, as well as breaching traffic regulations.
According to police, the driver, while in the oncoming lane, attempted to turn right, obstructing the path of a motorcycle. The result was fatal injuries to the motorcycle’s passenger and serious injuries to the rider.
The lower court had fined her €1,000, imposed eight penalty points on her driving license, and suspended her license for two months for the serious offense, along with an additional €200 fine for a second offense.
The case was appealed by the prosecution, arguing that the penalties were clearly inadequate given the severity of the crime and the need for general deterrence. Although the Supreme Court acknowledged that the defendant’s actions did not constitute “willful indifference,” it ruled that the lower court failed to adequately consider the seriousness and aggravating nature of such offenses.
As a result, the fine was increased from €1,000 to €3,000, while the other penalties (points and license suspension) remained unchanged.
